Atrium Carmichael Oaks, a 95‑bed licensed group home in Carmichael, has faced several compliance investigations over the past few years. In March 2021 the agency’s Community Care Licensing Division (CCLD) conducted an unannounced visit following a complaint about a refund owed to a deceased resident, R1. The investigation found that the facility failed to issue a refund within the 15‑day period required by Health and Safety Code §1569.652, even though the refund was eventually paid in early October. The agency documented the allegation as substantiated, cited a deficiency under the Health and Safety Code, and required the licensee to submit proof of review and a signed acknowledgment by March 17, 2021. Failure to correct the cited deficiency could trigger a civil penalty.

In July 2023, a second unannounced visit addressed concerns that a resident, again referred to as R1, had been improperly placed in the facility’s memory‑care wing after a physician’s diagnosis had been revised from dementia to delirium. The resident and his power‑of‑attorney had repeatedly expressed a desire to move to assisted‑living activities, but staff restricted his movement due to perceived cognitive deficits and staff unavailability. The investigation found the allegations substantiated, citing a deficiency under CCR 87705(k)(9) for retaining a resident whose primary diagnosis was no longer dementia and for limiting the resident’s personal rights. The agency required proof of staff retraining and documentation of the resident’s release from memory‑care duties by July 25, 2023. R1 ultimately left the facility to live with family.

An additional complaint investigated on the same day was deemed unsubstantiated, resulting in no corrective action or penalties. Together, these reports illustrate a pattern of lapses in both financial compliance and resident‑rights protection, raising concerns about the facility’s ongoing adherence to California’s health and safety regulations.
